NAVI MUMBAI: The National Green Tribunal (NGT) on Wednesday barred Cidco, the planning authority for Navi Mumbai, from leasing out a 25,000 sq m (6.2 acre) plot adjacent to the NRI Colony at Seawoods in Nerul that comes under CRZ. Local residents and activists have been fighting against a Cidco tender to auction the plot, set amid mangroves and flamingo habitat, for residential and commercial buildings. Two applications, filed by the Navi Mumbai Environment Preservation Society (NMEPS) and a group of six city residents, sought that Cidco be stopped from going ahead with the auction. The base price had been fixed at Rs 1.4 lakh per sq m. The petitions moved by advocates Zaman Ali and Meennaz Kakalia pointed out that approximately two-thirds of Plot 2A in Nerul sector 54-56-58 as described in the Cidco tender documents falls under CRZ 1 (no construction) and CRZ 2 (construction with several curbs). In its order, NGT's western zonal bench suggested a small part of the plot outside CRZ can used for a garden and social facilities as planned by the Navi Mumbai Municipal Corporation (NMMC) in its 2020 Development Plan (DP), which is awaiting government approval. In its petition, NMEPS said the plot is designated as a 'No Development Zone' under the DP of 2011 and also of 2020 and it falls on the seaward side of the existing road. Moreover, thousands of Schedule-I protected greater flamingos use the wetlands surrounding the plot for roosting. Any construction on the plot would have a serious impact on the ecology and flight path of these migratory birds, the applications said. A thick patch of mangroves is located in close proximity to the plot and, in fact, part of the land is located within the mangrove buffer zone, the joint application by Rekha Sankhala, Manmeet Singh Khurana, Ritu Mittal, R K Narayan, Mahendra Singh Panghaal, and Anjali Agarwal, said. After hearing all the parties and Cidco, the NGT bench of Justice Dinesh Kumar Singh, judicial member, and Dr Vijay Kulkarni, expert member, stopped the auction and ruled construction should be limited to only non-CRZ areas. Cidco sources said they can comment only after receiving the NGT order. NatConnect Foundation, which was among the first to raise the issue, hailed the NGT ruling as a significant development. Speaking for the six petitioners, Sankhala said they are happy with the verdict.
