Homebuyers seek damages from MahaRERA for project information update delay

Maharashtra Real Estate Regulatory Authority (MahaRERA) recently issued show cause notices to developers of 19,500 projects as they had not updated the mandatory project information according to Real Estate (Regulation and Development) Act. PUNE: A pan-India homebuyers’ association, Forum for People's Collective Efforts (FPCE), has sought compensation for consumers from MahaRERA over real estate developers not complying with the statutory project update on a quarterly basis and the regulatory authority overlooking the information for six years. Maharashtra Real Estate Regulatory Authority (MahaRERA) recently issued show cause notices to developers of 19,500 projects as they had not updated the mandatory project information according to Real Estate (Regulation and Development) Act. The regulator has started reviewing the projects registered since its inception in May 2017. Members of the forum are of the view that “this serious violation by the builders has been overlooked by the regulatory authority as homebuyers rely on website information for taking an informed decision to invest in a project”. FPCE president Abhay Upadhaya claimed that the delay in action by the regulator was an injustice to the homebuyers. “This is a serious violation by the builders and the issue has been overlooked by the regulator. The homebuyers are the biggest sufferers as they rely on the website information before making a decision. But the information are not updated. The homebuyers deserve compensation from the authority as well,” he told TOI. The general secretary of the homebuyers’ forum, MS Shankar, said, “Corrective steps are required to set things right and ensure that non-update of the information on websites does not become the new normal in other states.” MahaRERA issued around 16,000 notices to real estate developers in April for not receiving satisfactory responses regarding information about their projects. Maharera has clarified in a notice that this would be the last chance for the promoters to respond to the notices. In its second notice, MahaRERA said it would take serious note of the apathy towards customers of promoters who do not respond and will take further action as per RERA provisions.
