Bombay HC warns MLA of contempt for obstructing redevelopment project

The court was hearing a contempt of court petition filed by SD Corp which is carrying out a redevelopment project in Antop Hill. Of 850 slums categorised as eligible huts by SRA, 820 were given possession of alternative accommodation.
MUMBAI: Bombay High Court on Monday threatened to initiate contempt proceedings against BJP MLA from Sion Koliwada, Captain Tamil Selvan, for obstructing an eviction drive by SRA officials. HC directed that police would detain him if he creates a law and order problem.
The court was hearing a contempt of court petition filed by SD Corp which is carrying out a redevelopment project in Antop Hill. Of 850 slums categorised as eligible huts by SRA, 820 were given possession of alternative accommodation. The builder alleged that 13 of them had encroached and were declared non eligible but were refusing to vacate despite several notices, affecting the project.
S D Corp filed a writ petition in Bombay high court naming Selvan as a respondent and the court passed an order to proceed with removal of 13 huts. Following this court order, the SRA team and police on February 28 started demolition of eight huts when Selvan obstructed the SRA from carrying out any further demolition.
"The panchnama prima facie indicates that the obstruction was in fact created by the 6th Respondent (Selvan). We put the 6th Respondent to notice that his position does not permit him to impede or obstruct the implementation of orders of the court. In fact, it may constitute Criminal Contempt of Court under Section 2(c)(iii) of the Contempt of Courts Act 1971," the court said.
HC said it was refraining from immediate action since Selvan was not present. The HC bench of Gautam Patel and Neela Gokhale order said, "We will not hesitate to do so if necessary, if the contempt continues, if there is continued obstruction to the implementation of orders of the court, and we will count the present obstruction as the first act of contempt of court. We reiterate our order that eviction programme for SRA project will continue."
